GeoDataVision employs relational database software and Geographic Information Systems (GIS) to extract, compile map and organize loan data reported under the Community Reinvestment Act (CRA) and the Home Mortgage Disclosure Act (HMDA). The intended primary uses of this data are for CRA “Lending Test” compliance analysis as well as market analysis. GDV makes no express or implied warranties regarding the accuracy or completeness of the data contained in the federal databases. Any liability of GDV is limited solely to the price charged for the GDV product or service. GDV may, at its option replace a database or map that is shown to have inaccuracies or refund to the customer the amount paid for the original product or service. Furthermore, use of the Performance Benchmark data does not guarantee a performance rating under CRA. The judgments of examiners and regulators are not exclusively based on the lending market data contained in the Performance Benchmark Reports. Regulators consider a range of “performance context factors” such as community demographics and bank resources in addition to the loan market data to determine a final performance rating. Market-based lending data are but one important component in a range of performance context issues considered by regulators.
